Hubungan Pancasila Dengan Ham Beserta Contohnya

Sudah menjadi jawaban umum bahwa Pancasila sebagai dasar negara Indonesia dipersepsikan sangat menghargai hak asasi manusia (HAM). Tulisan ini tidak ingin menjungkirbalikkan persepsi demikian. Namun, seperti apa keterkaitan antara Pancasila sebagai dasar-dasar (pengaturan) HAM di Indonesia, tampaknya perlu ditelusuri.

Pancasila secara umum dipahami mengandung arti lima dasar. Kelima dasar ini adalah jiwa seluruh rakyat Indonesia, yang memberi kekuatan hidup kepada bangsa Indonesia serta membimbingnya dalam mengejar kehidupan lahir batin yang makin baik, di dalam masyarakat Indonesia yang adil dan makmur. Pengakuan atas eksistensi Pancasila ini bersifat imperatif atau memaksa. Artinya, siapa saja yang berada di wilayah NKRI, harus menghormati Pancasila sebagai pandangan hidup bangsa Indonesia. Pancasila juga merupakan sumber kejiwaan masyarakat dan negara Republik Indonesia.

Di sisi lain ada HAM, yaitu hak yang melekat pada diri setiap manusia sejak awal dilahirkan yang berlaku seumur hidup dan tidak dapat diganggu gugat siapa pun. Menurut Oemar Seno Aji (1966), HAM adalah hak yang melekat pada diri manusia sebagai insan ciptaan Allah SWT, sepeti hak hidup, keselamatan, kebebasan dan kesamaaan sifatnya tidak boleh dilangar oleh siapapun dan seolah-olah merupakan holy area. Sementara itu, menurut Kuncoro (1976), HAM adalah hak yang dimiliki manusia menurut kodratnya dan tidak dapat dipisahkan dari hakikatnya. G.J.Wollhof menambahkan, “HAM adalah sejumlah hak yang berakat pada tabi’at setiap pribadi manusia, dan tidak dapat dicabut oleh siapapun.”

HAM dalam Pancasila sesunguhnya telah dirumuskan dalam Pembukaan UUD 1945 yang kemudian diperinci di dalam batang tubuhnya yang merupakan hukum dasar, hukum yang konstitusional dan fundamental bagi negara Republik Indonesia. Perumusan alinea pertama Pembukaan UUD membuktikan adanya pengakuan HAM ini secara universal. Ditegaskan di awal Pembukaan UUD itu tentang hak kemerdekaan yang dimiliki oleh segala bangsa di dunia. Oleh sebab itu penjajahan di atas dunia harus dihapuskan karena tidak sesuai dengan perikemanusiaan dan perikeadilan.

Dasar-dasar HAM tertuang dalam UUD 1945 Republik Indonesia selanjutnya dapat ditemukan dalam sejumlah pasal Batang Tubuh UUD:

• Pasal 27 ayat (1): “Segala warga negara bersamaan kedudukannya dalam hukum dan pemerintahan dan wajib menjunjung hukum dan pemerintahan itu dengan tidak ada kecualinya”

• Pasal 28: “Kemerdekaan berserikat dan berkumpul, mengeluarkan pikiran dengan lisan dan tulisan dan sebagainya ditetapkan dengan undang-undang”

• Pasal 29 ayat (2): “Negara menjamin kemerdekaan tiap-tiap penduduk untuk memeluk agamanya masing-masing dan untuk beribadat menurut agamanya dan kepercayaannya itu”

• Pasal 30 ayat (1): “Tiap-tiap warga negara berhak dan wajib ikut serta dalam usaha pembelaan negara”

• Pasal 31 ayat (1): “Tiap-tiap warga negara berhak mendapat pengajaran”.

Hubungan antara Pancasila dan HAM di Indonesia dapat dijabarkan sebagai berikut:

1. Sila Ketuhanan yang maha Esa menjamin hak kemerdekaan untuk memeluk agama , melaksanakan ibadah dan menghormati perbedaan agama. Sila tersebut mengamanatkan bahwa setiap warga negara bebas untuk memeluk agama dan kepercayaannya masing-masing. Hal ini selaras dengan Deklarasi Universal tentang HAM (Pasal 2) yang mencantumkan perlindungan terhadap HAM

2. Sila kemanusiaan yang adil dan beradab menempatkan hak setiap warga negara pada kedudukan yang sama dalam hukum serta memiliki kewajiban dan hak-hak yang sama untuk mendapat jaminan dan perlindungan undang-undang. Sila Kedua, mengamanatkan adanya persamaan derajat, persamaan hak dan persamaan kewajiban antara sesama manusia sebagaimana tercantum dalam Pasal 7 Deklarasi HAM PBB yang melarang adanya diskriminasi.

3. Sila Persatuan Indonesia mengamanatkan adanya unsur pemersatu diantara warga Negara dengan semangat rela berkorban dan menempatkan kepentingan bangsa dan Negara diatas kepentingan pribadi atau golongan, hal ini sesuai dengan prinsip HAM Pasal 1 bahwa Semua orang dilahirkan merdeka dan mempunyai martabat dan hak-hak yang sama. Mereka dikaruniai akal dan hati nurani dan hendaknya bergaul satu sama lain dalam persaudaraan.

4. Sila Kerakyatan yang dipimpin oleh hikmat kebijaksanaan dalam permusyawaratan / perwakilan dicerminkan dalam kehidupan pemerintahan, bernegara, dan bermasyarakat yang demokratis. Menghargai hak setiap warga negara untuk bermusyawarah mufakat yang dilakukan tanpa adanya tekanan, paksaan, ataupun intervensi yang membelenggu hak-hak partisipasi masyarakat. Inti dari sila ini adalah musyawarah dan mufakat dalam setiap penyelesaian masalah dan pengambilan keputusan sehingga setiap orang tidak dibenarkan untuk mengambil tindakan sendiri, atas inisiatif sendiri yang dapat mengganggu kebebasan orang lain. Hal ini sesuai pula dengan Deklarasi HAM.

5. Sila Keadilan sosial bagi seluruh rakyat indonesia mengakui hak milik perorangan dan dilindungi pemanfaatannya oleh negara serta memberi kesempatan sebesar-besarnya pada masyarakat. Asas keadilan dalam HAM tercermin dalam sila ini, dimana keadilan disini ditujukan bagi kepentingan umum tidak ada pembedaan atau diskriminasi antar individu.

Pemahaman HAM Indonesia sebagai tatanan nilai, norma, sikap yang hidup di masyarakat berlangsung sudah cukup lama. Bagir Manan pada bukunya “Perkembangan Pemikiran dan Pengaturan HAM di Indonesia” ( 2001 ) membagi perkembangan HAM di Indonesia dalam dua periode yaitu: (1) periode sebelum Kemerdekaan dan (2) periode setelah Kemerdekaan.

1. Periode Sebelum Kemerdekaan. Pada periode ini ada beberapa upaya menuju diraihnya HAM seperti:

1. Periode ini diisi dengan Boedi Oetomo, yang telah memperlihatkan adanya kesadaran berserikat dan mengeluarkan pendapat kepada pemerintah colonial. Perhimpunan Indonesia, lebih menitikberatkan pada hak untuk menentukan nasib sendiri.

2. Sarekat Islam, yang menekankan pada upaya untuk memperoleh penghidupan yang layak dan bebas dari penindasan dan deskriminasi rasial. Dan ada beberapa organisasi lain yang bergerak dengan prinsip HAM seperti Partai Nasional Indonesia, mengedepankan pada hak untuk memperoleh kemerdekaan. Pemikiran tentang HAM pada periode ini juga terjadi perdebatan dalam sidang BPUPKI antara Soekarno dan Soepomo di satu pihak dengan Mohammad Hatta dan Mohammad Yamin pada pihak lain. Perdebatan pemikiran HAM yang terjadi dalam sidang BPUPKI berkaitan dengan masalah hak persamaan kedudukan di muka hukum, hak atas pekerjaan dan penghidupan yang layak, hak untuk memeluk agama dan kepercayaan, hak berserikat, hak untuk berkumpul, hak untuk mengeluarkan pikiran dengan tulisan dan lisan.

2. Periode Setelah Kemerdekaan. Pemikiran HAM pada periode ini adalah dalam upaya pembelaan hak untuk merdeka, hak kebebasan untuk berserikat melalui organisasi politik yang didirikan serta hak kebebasan untuk untuk menyampaikan pendapat terutama di parlemen. Periode ini ditandai dengan adanya semangat kuat untuk menegakkan HAM, walaupun pada sekitar awal tahun 1970-an sampai periode akhir 1980-an penegakan HAM mengalami kemunduran, Pemerintah pada periode Orde Baru bersifat defensif dan represif yang dicerminkan dari produk hukum yang umumnya restriktif terhadap HAM. Desakan bagi negara untuk makin menghormati HAM direspons dengan kelahiran Komisi Nasional HAM, yang pada tahap-tahap awal pembentukannya menuai keraguan, namun ternyata cukup mendatangkan optimisme. Pada periode 1998 dan setelahnya, dengan pergantian rezim pemerintahan pada tahun 1998 terlihat dampak yang sangat besar pada pemajuan dan perlindungan HAM di Indonesia, misalnya dengan dilakukannya amandemen UUD 45 dan beberapa peraturan perundang–undangan yang ada

Apabila HAM ini diklasifikasi, maka terdapat beberapa kelompok hak sebagai berikut:

1. Hak-hak pribadi (personal rights) meliputi kebebasan menyatakn pendapat,kebebasan memeluk                   agama.

2. Hak-hak ekonomi (property rights) hak untuk memiliki sesuatu, membeli atau menjual serta                           memanfaatkannya.

3. Hak-hak asasi untuk mendapatkan perlakuan yang sama dalam hukum dan pemerintahan (rights of legal         equality).

4. Hak-hak asasi politik (political rights) yaitu hak untuk ikut serta dalam pemerintahan.

5. Hak-hak asasi sosial dan budaya (social and cultural rights) misalnya hak untuk memilih pendidikan.

6. Hak-hak asasi untuk mendapatkan perlakuan tata cara peradilan dan perlindungan, peraturan dalam hal penangkapan (procedural rights).

Jadi singkat kata, dapat disimpulkan bahwa Pancasila sebagai pandangan hidup bangsa dan dasar negara Republik Indonesia sudah memberikan jaminan bahwa nilai-nilai yang ada dalam Pancasila itu sejalan dengan HAM. Oleh sebab itu, penghormatan kita terhadap HAM harus bersifat juga berskala universal. Kita menerapkan HAM dengan tidak mengenyampingkan nilai-nilai keluhuran sebagai manusia Indonesia.

• Ether3 = from switch to mikrotik
• Ether4 = from laptop to mikrotik (for setting mikrotik)
Open your winbox and input ip address mikrotik, username and password mikrotik anda.Jika mikrotik you blom have ip address, click [...] then choose your mac mikrotik address, for username default mikrotik ie admin, password not in content, leave empty.

Setting Interface MikroTik Open menu interfaces it will look like the following.

Interface: Wifi Address: 192.168.20.254/24

Setting IP Route MikroTik Open IP >> Routes menu, and then view and make sure it gets the ip gateway modem (will get an IP gateway modem was previously due in part ip dhcp-client already menceklis Add Default Route. Contoh sampah anorganik adalah sampah yang tidak mudah membusuk, seperti plastik, kayu, kaca, kaleng, dan sebagainya. Sampah anorganik didaur ulang oleh home industry untuk mengurangi jumlah sampah serta dijadikan sebagai peluang usaha. Berdasarkan bentuknya, sampah dapat dibedakan menjadi sampah padat, cair, alam, konsumsi, manusia dan radioaktif.

Sampah padat adalah sampah yang berwujud padat. Sampah padat dapat berupa sampah rumah tangga: sampah dapur, kebun, plastik, metal, gelas dan lain-lain. Sampah organik dan anorganik termasuk sampah padat. Sampah ini dapat dibedakan berdasarkan kemampuan diurai oleh alam atau biodegrability menjadi sampah padat biodegradable (sampah yang dapat diuraikan oleh proses biologi) dan sampah padat non-biodegradable (tidak dapat diuraikan oleh suatu proses biologi. Sampah padat non-biodegradable ada dua jenis yaitu recyclable (dapat diolah kembali) dan non-recyclable (tidak dapat diolah kembali).

Sampah Cair adalah bahan cairan yang telah digunakan dan tidak diperlukan lagi seperti limbah. Limbah adalah sampah cair yang dihasikan dari aktivitas industri. Limbah dapat dibagi menjadi dua yaitu limbah hitam dan limbah rumah tangga. Limbah hitan adalah sampah cair yang mengandung patogen berbahaya yang berasal dari toilet, sedangkan limbah rumah tangga adalah sampah cair yang dihasiklan dari dapur, kamar mandi, dan tempat cucian.

Sampah alam merupakan sampah yang diproduksi oleh alam dan diuraikan melalui proses daur ulang alami. Contoh dari sampah alam adalah daun kering di hutan yang terurai menjadi tanah. Sampah manusia adalah istilah yang digunakan terhadap hasil-hasil pencernaan manusia, seperti feses dan urin. Sampah manusia dapat menimbulkan dampak negatif bagi kesehatan manusia karena dapat dikatakan sebagai sarana perkembangan penyakit yang disebabkan oleh virus dan bakteri.

Sampah konsumsi merupakan sampah yang dihasilkan oleh kegiatan konsumsi manusia dan dibuang ke tempat sampah. Jumlah sampah konsumsi sampai sekarang tidak melebihi jumlah sampah industri. Limbah radioaktif adalah sampah nuklir yang merupakan hasil dari fusi nuklir dan fisi nuklir yang menghasilkan uranium dan thorium. Limbah radioaktif berbahaya bagi lingkungan dan kehidupan manusia karena menghasilkan radiasi yang berdampak buruk terhadap kesehatan manusia. Oleh karena itu sampah nuklir disimpan ditempat-tempat yang tidak berpotensi tinggi.

Radioactive waste is a nuclear waste that is the result of nuclear fusion and nuclear fission that produces uranium and thorium. Radioactive waste is harmful to the environment and human life because it produces radiation that adversely affects human health. Therefore nuclear waste is stored in places that are not high potential.

PENDAHULUAN

Praktek Kerja Industri (Prakerin) merupakan bentuk penyelenggaraan pendidikan keahlian profesional yang memadukan secara sistematik dan sinkron antara program pendidikan sekolah dengan penguasaan keahlian yang diperoleh melalui kegiatan langsung didunia usaha/industri, sehingga kegiatan Prakerin merupakan implementasi dari pendidikan yang sudah berjalan dalam bentuk pelaksanaan Pendidikan Sistem Ganda (PSG).

Dalam kegiatan Prakerin dituntut adanya perubahan dan pengembangan sumberdaya manusia dengan menyiapkan tenaga kerja yang terampil, mandiri dan professional sesuai dengan bidang keahliannya.

KETENTUAN UMUM

1. Siswa peserta Prakerin adalah siswa kelas XI (sebelas) semester 2 (dua).

2. Sebelum pelaksanaan Prakerin, setiap siswa peserta diwajibkan mengikuti kegiatan pembekalan                   Prakerin.

3. Lokasi pelaksanaan Prakerin berdasarkan pengajuan siswa peserta Prakerin, yang harus disetyjui dan          ditetapkan oleh Panitia Prakerin SMK Plus Qurrota A’yun).

4. Setiap siswa peserta Prakerin diwajibkan membuat laporan pelaksaann Prakerin dan diserahkan                    kepada Panitia Prakerin sebanyak 2 (dua) rangkap.

5. Laporan diserahkan paling lambat 7 (tujuh) hari setelah berakhirnya pelaksanaan Prakerin.

6. Ujian Prakedrin diselenggarakan oleh Panittia Prakerin 14 (empat belas) hari setelah berakhirnya                   pelaksanaan Prakerin.

7. Pembimbing Prakerin bagi setiap siswa peserta Prakerin ditetapkan oleh Panitia Prakerin dan                       diketahui/disetujui oleh Kepala SMK Plus Qurrota A’yun.

8. Setiap siswa peserta Prakerin diwajibkan mentaati seluruh tata tertib yang ditetapkan.
